Terms of Service

Please read these Terms of Service ("Terms") carefully before using the Gymtedd mobile application or website (collectively, the "Service"). By creating an account or using the Service you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Service.

1. The Service

Gymtedd is an AI-powered fitness application that provides personalised workout plans, body composition analysis, nutrition scanning, step tracking, and related features. The Service is operated by Digital Okonma Technologies Ltd., a company incorporated in Nigeria under Registration Number 9345217.

2. Eligibility

• You must be at least 13 years old to use Gymtedd.
• Users aged 13–17 require verified parental or guardian consent.
• You must provide accurate registration information.
• One account per person. You may not share, sell, or transfer your account.

3. Account Responsibilities

You are responsible for maintaining the confidentiality of your account credentials. Notify us immediately at support@Gymtedd.com if you suspect unauthorised access. We are not liable for losses resulting from unauthorised use of your account where you failed to keep credentials secure.

4. Subscription Plans & Payments

4.1 Tiers

• Free: ₦0 — permanent access with limited AI quotas (3 nutrition scans/mo, 3 AI images/mo, 1 lifetime body analysis).
• Fit Pro: ₦4,500/month or ₦35,000/year — expanded quotas (30 scans, 30 images, 5 videos, monthly body re-analysis).
• Fit Elite: ₦9,000/month or ₦65,000/year — unlimited scans and images, 15 videos/mo, 4 body analyses/mo.

4.2 Billing

• Payments are processed by Paystack (NGN cards) or PayPro Global (international).
• Subscriptions renew automatically at the end of each billing cycle.
• Prices may change with 30 days notice. You may cancel before the change takes effect.
• All prices are inclusive of applicable taxes where required by law.

4.3 Cancellation

You may cancel your subscription at any time from the app's account settings. Access continues until the end of the current billing period. No partial refunds are issued for unused periods except under Section 6 (Refund Policy).

5. Referral Program

Referral bonuses (7 free days for referrer and referee when the referee subscribes to a paid plan) are applied automatically. DOT reserves the right to modify or discontinue the referral program at any time. Abuse of the referral system (e.g., self-referrals, fake accounts) will result in account termination and forfeiture of bonuses.

6. Refund Policy

Paid subscriptions come with a 30-day money-back guarantee. To request a refund, email support@Gymtedd.com within 30 days of your first payment for that subscription period. One refund per account lifetime. See our full Refund Policy.

7. Acceptable Use

You agree not to:

• Upload images of other people without their consent.
• Upload illegal, harmful, or sexually explicit content.
• Attempt to reverse-engineer, decompile, or extract the app's source code.
• Use automated tools to scrape or overload the Service.
• Resell, sublicense, or commercially exploit any part of the Service without written permission from DOT.
• Create multiple accounts to abuse free-tier quotas.
• Use the Service for any unlawful purpose under Nigerian or applicable international law.

8. AI-Generated Content

Workout plans, body analysis results, nutrition breakdowns, and AI-generated images/videos are provided for general fitness guidance only and do not constitute medical advice. Always consult a qualified healthcare professional before starting any new exercise or nutrition programme, especially if you have a pre-existing medical condition. DOT is not liable for injury or health outcomes resulting from following AI-generated content.

9. Intellectual Property

All content, software, trademarks, logos, and design elements within the Service are owned by or licensed to Digital Okonma Technologies Ltd. You may not reproduce, distribute, or create derivative works without prior written consent.

You retain ownership of photos and personal data you upload. By uploading content you grant DOT a limited, non-exclusive licence to process and store it solely to provide the Service to you.

10. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to fitness for a particular purpose, merchantability, or uninterrupted availability. We do not guarantee that AI analysis outputs are free from errors.

11. Limitation of Liability

To the maximum extent permitted by Nigerian law, DOT's total liability to you for any claim arising from use of the Service shall not exceed the amount you paid to DOT in the 12 months preceding the claim. DOT is not liable for indirect, incidental, consequential, or punitive damages.

12. Governing Law & Disputes

These Terms are governed by the laws of the Federal Republic of Nigeria. Any dispute arising out of or in connection with these Terms shall first be subject to good-faith negotiation. If unresolved within 30 days, disputes shall be submitted to the exclusive jurisdiction of the courts of Lagos State, Nigeria.

13. Termination

We may suspend or terminate your account immediately if you violate these Terms or engage in fraudulent or harmful conduct. You may delete your account at any time from the app settings. Upon termination, your right to use the Service ceases and we will delete your data per our Privacy Policy.

14. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes via push notification and email at least 14 days before they take effect. Continued use of the Service after the effective date constitutes your acceptance of the updated Terms.
